It shall be unlawful for any person to drive or move or for the owner to cause or knowingly permit to be driven or moved on any highway any vehicle or combination of vehicles in such unsafe condition as to endanger any person or which does not contain those parts or is not at all times equipped with such lamps and other equipment in proper condition and adjustment as required in the code of Iowa, as amended, or equipped with one or more unsafe tires. A. No person shall operate any vehicle when such vehicle is so loaded or when there are in the front seat such number of persons, exceeding three (3) in number, as to obstruct the view of the driver to the front or sides or to interfere with the driver's control over the driving mechanism of the vehicle.
B. No person shall ride in such position as to interfere with the driver's view ahead or to the sides or to interfere with the driver's control over the driving mechanism of the vehicle.
C. No stickers, signs or posters shall be placed in or on any window of a vehicle, except as required by the state or any governmental subdivision or agency thereof. (1978 Code §23-136)
A. Application Of Provisions: Except for motorcycles or motorized bicycles, 1966 model year or newer vehicles subject to registration in Iowa shall be equipped with safety belts and safety harnesses of a type and installed in the manner required by the code of Iowa, as amended.
B. Use Required: The driver and front seat occupants of a type of motor vehicle subject to registration in Iowa, except a motorcycle or a motorized bicycle, shall each wear a properly adjusted and fastened safety belt or safety harness any time the vehicle is in forward motion on a street or highway in this city, except a child under six (6) years of age shall be secured as required under subsection C of this section.
C. Child Restraint Devices:
1. A child under the age of three (3) years, who is being transported in a motor vehicle subject to registration and having a gross weight of less than ten thousand (10,000) pounds, shall be secured during transit by a child restraint system which meets federal motor vehicle safety standards, and the system shall be used according to the manufacturer's instructions.
2. A child at least three (3) years of age but under the age of six (6) years, who is being transported in a motor vehicle subject to registration and having a gross weight of less than ten thousand (10,000) pounds, shall be secured during transit as required by subsection C1 of this section or as required by subsections A and B of this section.
3. The vehicle driver who violates subsection C1 or C2 of this section is guilty of a simple misdemeanor and shall not be subject to a penalty greater than that provided by the code of Iowa, as amended.
D. Liability: The driver and front seat passengers and owner may each be charged separately for improperly used or nonused equipment under this section. (1994 Code)
