608.99 PENALTY.
   (a)   Any person who violates this Chapter may be responsible for a municipal civil infraction violation punishable by a municipal civil infraction fine not to exceed $500.00 and the costs of prosecution.
   (b)   As to the first or second offense, the violation shall be a civil infraction, and upon a finding of responsibility, the violator shall be fined as set forth below.
   (c)   As to the third or subsequent offense, the violation shall be a misdemeanor, and upon conviction, the violator shall be imprisoned for not more than ninety days, fined in an amount not to exceed $1,000.00 and/or required to perform not more than 240 hours of community service.
   (d)   In addition, court costs may be levied against any person determined to be guilty of or responsible for a violation.
Certain violations of this Chapter (Sections 608.02, 608.03, 608.06(a)(1), 608.06(a)(8), 608.08, 608.09, and 608.11), shall be a misdemeanor and upon conviction thereof and shall be punishable by a fine of not more than $500.00 and/or 90 days in jail, or both, as specified below in the Animal Control Fine and Penalty Schedule.
