§ 136.35  FRAUD AND DECEIT IN SALE.
   It shall be unlawful for any person to commit or use any fraud, scheme, device, trick, deceit, misrepresentation, subterfuge or nay other form of concealment for the purpose of obtaining money or any other thing of value by the sale, furnishing, supplying, or giving away of any substance which by its appearance or  which is represented to be  a  drug as  is defined in  Act No. 368 of the Public Acts of Michigan of 1978 (MCL 333.7101 et seq., MSA 14.15 (7101) et seq.) as amended, when the same may or may not be the same.
