The city has adopted this subchapter after extensive study and on the following determinations made by it:
(A) That there is a fundamental conflict between the operation of filling and/or service stations, as defined in this subchapter, and the quiet, peaceful enjoyment of adjacent areas;
(B) That the unrestricted and unregulated operation of a service station and/or filling station, in the finding of the Council, constitutes a public nuisance, and is detrimental to the general health, welfare and safety of the people of the city;
(C) That, among other things, the noise, odor, lights, fumes, vibration, dust, danger of fire and/or explosion, traffic problems, incidental to the operation of filling and/or service stations, are factors peculiar to this business which warrant its being the subject of regulation as set forth in this subchapter; and
(D) That the City Council has determined, after study and review of complain to received by it, that it is necessary in the public interest and for the reasons hereinbefore mentioned to regulate all filling or service stations operating in the city, and to establish uniform rules for the location, equipping and operation of the same within the city.
