(A) Any person, firm or corporation who shall fail to comply with any of the provisions of §§ 117.70 through 117.84 shall, upon conviction thereof, be subject to a fine of not more than $500 or imprisonment in the jail of the city or any other place of confinement provided by the city for such purpose in the discretion of the Court for a period not to exceed 90 days, or both such fine and imprisonment at the discretion of the Court unless otherwise provided in this subchapter.
(B) Except as provided for in division (A) of this section, a person licensed or registered under §§ 117.70 through 117.84 who commits a violation of §§ 117.70 through 117.84 that is not a Minor Violation as described in the General Rules or a person not licensed or registered under §§ 117.70 through 117.84 who is performing any activity related by §§ 117.70 through 117.84 is guilty of a civil violation, punishable by a fine of not less than $1,000 per day for each day the violation except that a fine shall not exceed $5,000 in total per violation. A second or subsequent violation is punishable by a fine of not less than $2,000 per day for each day the violation occurs except that a fine shall not exceed $10,000 in total per violation.
