§ 94.01 TITLE.
   This chapter may be known and cited as The City Anti-Litter Regulations.

§ 94.02 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   AUTHORIZED PRIVATE RECEPTACLE. The Department of Public Services shall approve the use and type of all private receptacles as may be utilized in this chapter.
   EVICTION. To physically expel the personal possessions of an occupant, owner, tenant, or previous occupant, owner, tenant, through court order or otherwise.
   GARBAGE. Putrescible animal and vegetable wastes resulting from the handling, preparation, cooking and consumption of food.
   LITTER. Garbage, refuse and rubbish as defined herein, all other waste materials and all other objects and materials including, but not limited to, furniture, appliances, clothing and all other household objects which, if thrown or deposited as herein prohibited, creates a danger to public health, safety and welfare.
   PARK. A park, reservation, playground, beach, recreation center, or any other public area in the city, owned or used by the city and devoted to active or passive recreation.
   PERSON. Any person, firm, partnership, association, corporation, company, or organization of any kind.
   PRIVATE PREMISES. Any dwelling, house, building or other structure, designed or used either wholly or in part for private residential purposes, whether inhabited or temporarily or continuously uninhabited or vacant, and shall include any yard, grounds, walk, driveway, porch, steps, vestibule or mailbox belonging or appurtenant to such dwelling, house, building, or other structure.
   PUBLIC PLACE. Any and all streets, sidewalks, boulevards, alleys or other public ways and any and all public parks, squares, spaces, grounds, and buildings.
   REFUSE. All putrescible and nonputrescible solid wastes (except body wastes), including garbage, rubbish, ashes, street cleanings, dead animals, abandoned automobiles and solid market and industrial wastes.
   RUBBISH. Nonputrescible solid wastes consisting of both combustible and noncombustible wastes, such as paper, wrappings, cigarettes, cardboard, tin cans, grass clippings, wood, glass, bedding, crockery, and similar materials.
   VEHICLE. Every device in, upon or by which any person or property is or may be transported or drawn upon a highway, including devices used exclusively upon stationary rails or tracks.

LITTERING IN PUBLIC PLACES, WAYS AND AREAS
§ 94.15 LITTER IN PUBLIC PLACES.
   No person shall throw or deposit litter in or upon any street, sidewalk, public easement including the area between the sidewalk and the curb or any other public place within the city except in public receptacles or in authorized and approved private receptacles for collection, or in official city dumps. The Department of Public Services shall approve the use and type of all private receptacles as may be utilized in this chapter.

§ 94.16 PLACEMENT OF LITTER IN RECEPTACLES SO AS TO PREVENT SCATTERING.
   Persons placing litter in public receptacles or in authorized private receptacles shall do so in such a manner as to prevent it from being carried or deposited by the elements and/or animals upon any street, sidewalk, easement including the area between the sidewalk and the curb or any other public place.

§ 94.17 REMOVAL OF PRIVATE RECEPTACLES FROM PUBLIC PROPERTY.
   Private receptacles for the collection of litter shall be removed from public property, including the area between the sidewalk and the curb, within 24 hours after the city truck has made the collection or in a case where the Department of Public Services has authorized and approved the use of a private receptacle within 48 hours. In the event the owner of the property has failed to remove a private receptacle from any public property, including the area between the sidewalk and the curb after being authorized by the Department of Public Services to place same on public property, then in such event the city shall remove said private receptacle from the public property and invoice the owner of said property in the manner provided in this chapter for the cost of removal of the private receptacle together with the costs of removal and disposing of such litter by the city.
