§ 92.011  ADDITIONS, INSERTIONS, AND CHANGES.
   The following sections are hereby added, deleted, or revised as follows:
   4.1 Section F-101.1:  TITLE.
   “Regulations shall be known as the Fire Prevention Code of the City of Inkster, hereinafter referred to as `this code’ or `this ordinance.’”
   4.2  Section F-105.2 is hereby amended to read as follows:
   “F-105.2  APPOINTMENT.
   The Department of Fire Prevention is hereby created, and the Executive Official in charge thereof shall be known as the Fire Code Official.  The Fire Official of the City of Inkster shall be the Mayor and any duly authorized representative.”
   4.2  Chapter 31 FIREWORKS is hereby amended by deleting therefrom Sections F-3101.0 through F-3103.6 and by adding as new Chapter 31 Fireworks to read as follows:
   “REGULATIONS REGARDING THE SALE OF FIREWORKS:
   A.   Any person selling, displaying, or discharging any type of fireworks that are lawful for sale must have a valid permit issued by the Chief of the City of Inkster Fire Department.  Fees for said permits shall be established, from time to time, by resolution of the City Council.
   B.   All fireworks shall be allowed for sale only in the Business and Industrial Zoning Districts and shall be sold only from an approved permanent building structure.  Said building structure shall be inspected by the City’s Structural/Safety, Police, and Fire Departments to determine compliance with all ordinance, code, and state law requirements.  The selling of fireworks from automobiles, vans, campers, or other vehicles, trailers, tents, road side stands, temporary structures or facilities, etc., is strictly prohibited.
   C.   All individuals selling, displaying, or producing fireworks shall be at least 18 years old to sell, display or possess fireworks.
   D.   Permits for the sale of fireworks shall not be issued to any person and/or business establishments which are located within 500 feet of any school district property.
   E.   Application for permits for the sale, display, or discharge of fireworks shall be made at least 21 days prior to the dates of any sale, display, or discharge.
   F.   All fireworks requested to be sold, displayed, or discharged shall be approved by the Chief of the City of Inkster Fire Department at the time of application of permit.  Only those items approved may be sold, displayed, and/or discharged at the location for which said permit has been issued.
   G.   No permit shall be issued to any persons requesting to sell, display, and/or discharge any fireworks unless the person making application therefor shall furnish proof of financial responsibility as evidenced by a bond or insurance policy in the amount of Three Hundred Thousand ($300,000.00) Dollars to satisfy damages to property and Five Hundred Thousand ($500,000.00) Dollars to satisfy damages for personal injured.  The City of Inkster shall be named as an additional insured party on said bond or insurance policy.  No permit shall be issued until the said bond or insurance policy is approved by the City Attorney.
   H.   Any unfired fireworks, trash, and debris that remain after the display or discharge of fireworks is concluded shall be immediately disposed of in an approved and safe manner.
   I.   The City of Inkster shall seize, take, confiscate, remove, or cause to be removed at the expense of the owner, seller, operator, or person in charge of possession of all stocks of fireworks that are offered for sale, stored upon the premises, displayed or discharged, or are stored, held upon the premises, or possessed in any manner in violation of the provisions of this ordinance and/or the requirements of state law.”
4.4  Add new Sections F-316.0 Key Boxes - Rapid Entry System, F-316.1 General, F-316.2 Additional Rapid Entry Occupancies, and F-316.3 Type, Contents, Installation, which sections read as follows:

   Enacting Ordinance No. 766 did not contain provisions for F-316.0 Key Boxes - Rapid Entry System, as above stated, and added an additional F-316.4, although not above stated.
   F-316.1  GENERAL
   “The Fire Official may require a box (vault) to be installed in an accessible location where immediate access is necessary to verify the existence of a fire or other emergency in those buildings equipped with, or required to be equipped with, fire detection or fire suppression systems or equipment.  The key box (vault) shall contain keys for elevator return and door opening, elevator rooms, fire alarm box, fire alarm box room, electric rooms, and any other key necessary for access to occupied floors within the structure for emergency fire and rescue purposes.”
   F-316.2  ADDITIONAL RAPID ENTRY OCCUPANCIES
   “When access to or within a structure or an area is unduly difficult because of secured openings or where immediate access is necessary for lifesaving or firefighting purposes.  In all residential occupancies that are locked for security reasons and that have common corridors to living units.  In any commercial occupancy of 10,000 square feet or larger.  In any commercial structure, without windows, and any structure over forty (40) feet in depth.  Windows that are covered to the extent that quick access and visibility to the inside of the structure are blocked will not be considered as windows.  Windows that are of such size, shape, or in a location that does not provide quick access and visibility to the inside of the structure will not be considered as windows.”
   F-316.3  TYPE, CONTENTS, INSTALLATION
   “The key box (vault) shall be a type approved by the Fire Official; shall contain keys to gain necessary access as required by the Fire Official; and shall be installed in a manner approved by the Fire Official.”
   F-316.4
   “At the request of the owner or lessee, the Fire Official shall permit him to install a key box (vault) tamper switch connected to the building’s fire alarm system.”
4.5  Add new Sections F-317.0  False Alarms of Fire:
   “F-317.1  GENERAL
   It shall be unlawful for any person to commit any one or more of the following actions:
   (a)   Raise a false alarm of fire at any gathering or in any public place;
   (b)   Ring any bell or operate any mechanical apparatus, electrical apparatus, or combination thereof for the purpose of creating a false alarm of fire;
   (c)   Raise a false alarm of fire orally, by telephone, electronically, or in person.”
   F-317.2  CIVIL SANCTIONS
   Any person who shall commit any one or more of the aforesaid actions involving the commission of a false alarm of fire shall pay the actual costs incurred by the City in responding to the alarm.”
