§ 91.01  CRUELTY TO ANIMALS.
   (A)   This section may be cited as the Cruelty to Animals Regulations.

   (B)   Whoever overdrives, overloads, drives when overloaded, overworks, tortures, torments, deprives of necessary sustenance, cruelly beats, mutilates or cruelly kills or causes or produces to be so overdriven, overloaded, driven when overloaded, overworked, tortured, tormented, deprived of necessary sustenance, cruelly beaten, mutilated or cruelly killed, any animal or whoever having the charge or custody of any animal, either as owner or otherwise inflicts unnecessary cruelty upon the same, or willfully fails to provide same with proper food, drink, shelter or protection from the weather, shall be guilty of this offense.

   (C)   The cropping of dogs’ ears and tails shall be considered a mutilation or cruelty to an animal within the meaning of this section unless the cropping is performed by a registered veterinarian surgeon while the dog is under anesthetic.
