(A) (1) Whenever any vehicle shall be found parked in any parking meter space overtime and beyond the period of legal parking time established for such space, or shall be found parked in violation of any of the provisions of this subchapter, such vehicle may be removed by or under the direction of any persons authorized to enforce this subchapter, by means of towing the same, to the automobile and vehicle pound; and such removal shall be at the risk of the owner.
(2) Before the owner or person in charge of such vehicle shall be permitted to remove the same from such pound, he shall furnish evidence of his identity and ownership or right to possession; shall sign a receipt for said vehicle; and for a first violation shall pay a towage fee of $3 plus storage charges of $.50 per day; and for each subsequent violation he shall pay a fee of $5 plus storage and towage charges as aforesaid; however, such enforcing officer may, in lieu of towing such vehicle to said pound, serve upon the owner or operator of such vehicle or attach or fasten to such vehicle a notice directing the owner or operator thereof to appear at the municipal court within the time specified in such notice.
(B) The Police Department shall take charge of and collect all moneys on parking meter violations.
(1) If parking violation is paid within one hour from issuance of summons, a fee of $.25 shall be paid.
(2) If parking violation is paid within 72 hours following its issuance, a fee of $1 shall be paid.
(3) If summons is not paid as above, it becomes a violation and goes to the municipal court to be processed.
(C) In the event any person fails to comply with a notice from the court to which said traffic violation notice was assigned, or fails to make an appearance pursuant to a summons directing an appearance in court, the Chief of Police shall forthwith request a complaint to be entered against such person and a warrant for his or her arrest.
(D) All sums collected by the court under the provisions of this subchapter, and all fines or penalties imposed arising out of parking meter violations, shall be paid to the City Treasurer.
