§ 37.19  CONTRACT COMPLIANCE OFFICER; FUNCTION AND DUTIES.
   The Contract Compliance Officer shall be the Personnel Director of the city, which office shall have the following duties for the encouragement of local, minority and female business enterprises:
   (A)   Administration and enforcement of this subchapter.
   (B)   The establishment of written procedures to effectuate this subchapter.
   (C)   The establishment of procedures to meet city goals to insure the participation of local, minority and female business enterprises in eligible contracts on the prime level, such procedures to include:
      (1)   The development of a local, minority and female business enterprise directory to be maintained as a public record;
      (2)   Consultation with the appropriate offices and departments within the city to determine and implement methods of attracting qualified LBEs, MBEs and FBEs;
      (3)   Administration of a program to assist LBEs, MBEs and FBEs who need assistance in meeting the city insurance and bonding requirements;
      (4)   Regular notification, by advertisement and writing, to inform qualified LBEs, MBEs and FBEs of pending eligible projects to be bid.
   (D)   The determination in writing, with reasons therefor, whether potential contractors are in compliance with this subchapter, to be made prior to the award of any bid or the execution of any eligible project.
   (E)   Holding pre-award conferences with potential contractors and subcontractors for the purpose of insuring that said office has all available information with which to make a determination of compliance.
   (F)   Investigations of alleged violations of this subchapter, and the issuance of written determinations following these investigations, stating the reasons therefor.
   (G)   Provision to all business entities of all necessary forms, applications, documents and papers necessary to comply with this subchapter.
   (H)   The review of cases where contractors fail to implement previously made LBE, MBE or FBE commitments to determine whether there should be further efforts to alternative approaches, including but not limited to contact with industry or any pertinent federal agency for information concerning the availability of qualified LBEs, MBEs and FBEs.
   (I)   Certification of contractors as bona fide LBEs, MBEs or FBEs, in accordance with the standards set forth in this subchapter.
   (J)   Recommendation to the Mayor and City Council of further efforts needed to insure participation.
