§ 37.17  DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   BIDDER.  Any person, firm, partnership, corporation, association or joint venture seeking to be awarded a public contract.
   CONSTRUCTION CONTRACT.  Any public contract for the construction, rehabilitation, alteration, conversion, extension or repair of buildings, streets or other improvements to real property, exceeding $10,000.
   CONTRACTOR.  Any person, firm, partnership, corporation, association or joint venture which has been awarded a public contract.
   ELIGIBLE PROJECT.  Any public contract awarded by the city to perform public works, community development construction and purchasing contract whereby the city expended or commits the expenditure of $10,000 or more for the construction or repair of improvements of real property, or whereby the city grants concession rights having a value exceeding $10,000 per annum to occupy or use city property.
   FEMALE BUSINESS ENTERPRISE (FBE).  A business entity at least 51% of which is owned by females and certified as such by the city.
   LOCAL BUSINESS ENTERPRISE (LBE).  A business entity at least 51% of which is owned by residents of the city or which is located within the corporate limits of the city, and certified as such by the city.
   MINORITY BUSINESS ENTERPRISE (MBE).  A business entity at least 51% of which is owned by minority persons and certified as such by the city.
   MINORITY PERSON.  Any American citizen or permanent resident alien of the United States who is Black, Hispanic, Asian or American Indian.
   PUBLIC CONTRACT.  Any contract awarded by the city, other than a contract between the city and another municipal, county, state or federal governmental body or agency or division thereof, or a public authority, having a value exceeding $10,000, whereby the city expended or commits the expenditure of the funds in return for work, labor, services, supplies, equipment, materials or any combination of the foregoing; or any lease, lease by way of concession, concession agreement, permit or permit agreement whereby the city leases, grants or demises property of the city or otherwise grants a right or privilege to occupy or use property of the city for monetary consideration other than payment of a permit fee; or any lease by the city of personal property.  This definition shall include any contract, the value of which, when combined with all other public contracts awarded within the preceding 12 months to the same person or entity, exceeds $40,000.
   SOLE SOURCE.  A contract which is determined by the Mayor or his designee to be the only source, by reason of geographical location or specialized resources, from which labor, services supplies, equipment or materials for a particular purpose can be obtained.
   SUBCONTRACTOR.  Any named person, firm, partnership, corporation, association or joint venture which supplied work, labor, services, supplies, equipment, material or any combination of the foregoing for a public contract, under contract with the contractor.  This definition shall not include lower subcontractors, or those with subcontracts of $10,000 or less on construction contracts; subcontractors supplying any services other than professional or construction services for concession-type public contracts; or subcontractors for lease-type service or permit-type public contracts.
   SUPPLIER.  Any contractor who furnishes supplies, material, equipment or personal property of any type or description to the city.
