§ 34.01  CIVIL SERVICE COMMISSION ESTABLISHED.
   (A)   Organization and administration.
      (1)   The Civil Service Commission shall consist of three members, appointed in accordance with Charter, Section 19.1(c). The members of the Commission shall be persons in sympathy with the application of merit principles to public employment. No member of the Commission shall hold any other elective or appointive office in the city, nor be employed by the city in any capacity, except for contractual employees. 
      (2)   The civil service system shall become effective upon the adoption of this subchapter. The members of the Civil Service Commission shall receive for their services such compensation as shall be  determined by the Council. The Commission shall meet at least monthly in a location designated by the City Council.  Minutes shall be taken for each regular and special meeting in the English language and a copy of said minutes shall be filed with the City Clerk.  Vacancies shall be filled for unexpired terms by the party making the appointment.  Two members of the Commission shall constitute a quorum for the conduct of the business of the Commission.  The Council may remove any member of the Commission, but only after serving such member with a statement in writing of the reasons for such removal and allowing such member to be publicly heard in his defense before the City Council.  The Commissioner, whose term of office shall next expire, shall serve as Chairperson of the Commission.  The personnel program established under this subchapter shall be administered by the Mayor or his designated representative.  The Mayor or his designated representative shall attend all meetings of the Civil Service Commission, and maintain minutes and record of all meetings; administer all the provisions of this subchapter and the personnel rules and regulations; and prepare and recommend revisions and amendments to the personnel rules and regulations.

   (B)   Powers and duties of the Commission.  In order to carry out and make effective the purpose and intent of the provisions of this subchapter in establishing a civil service system, the Civil Service Commission shall:
      (1)   Establish and administer a position-classification plan, an examination program, rules and regulations governing the terms and conditions of employment and service;
      (2)   Establish and administer rules and regulations governing residence requirements, probation periods, service records, seniority, hours of service, work-week, vacation leaves, leaves-of-absence, time off, promotions, demotions, suspensions, removals, reinstatements, resignations, lay-offs and age limits;
      (3)   Make such rules and regulations, not inconsistent with the Charter, as it deems necessary and advisable for the administration of the civil service system;
      (4)   Investigate and enforce the provisions of this subchapter and, through its authorized representatives or its own members, administer oaths and subpoena and compel attendance of witnesses and the production of records in connection with any matter property before it;
      (5)   Make annual reports of its activities to the Mayor or City Council and such special reports as may be requested by the Manager or Council; and
      (6)   May contract, with approval of the Manager, for such technical services and advice as may be reasonably necessary to the performance of the foregoing duties.
