§ 150.217  CONDITIONS FOR GRANTING PERMIT.
   If it appears from the fully and accurately completed permit application and the inspection report that the building or structure and the site of origin plan meet all of the building and zoning requirements, a permit shall be issued. The applicable requirements include the building, electrical, plumbing, heating and refrigeration codes and the requirements of the zoning ordinance applicable to the site of origin and the site of destination. In addition, if the building or structure does not meet the requirements of the various codes and ordinances referred to above but in the opinion of the City Manager, can be improved so as to meet these requirements, a permit shall be issued. In any event, however, a permit to move the building or structure shall be issued by the Department of Structural Safety only if the applicant establishes the following to the satisfaction of the Department of Structural Safety:
   (A)   Application has been made for applicable permits required under the building, electrical, plumbing, heating and refrigeration codes and all fees required are paid. The site of origin will, after the move, comply with the zoning ordinance.
   (B)   A valid building permit has been issued for the proposed location of the building or structure, if the location is within the city and the foundation plan approved along with an approved building permit and certified written evidence that the foundation will be constructed prior to the actual physical moving of the structure proceeding to its destination.
   (C)   A cash deposit or irrevocable letter of credit, the form and content of which shall have been approved by the City Attorney, has been deposited with the city guaranteeing the completion of the move of the building or structure to, from or through the city within ten days of the initiation of the move of the building or structure and further guaranteeing timely cleanup as is elsewhere in this subchapter specifically provided, the deposit to be in an amount as established by resolution of the City Council.
   (D)   A cash deposit for inspection of the physical move in an amount established by resolution of the City Council has been deposited with the city.
   (E)   If the moving of the structure or building requires transportation on city streets, an oversize and/or overweight permit shall be required in accordance with law and/or ordinances.
