§ 112.99  PENALTY.
   (A)   Whoever violates any provision of this chapter for which another penalty has not been provided shall upon conviction be fine not more than $500 and costs of prosecution, or by imprisonment for not more than 90 days, or by both such fine and imprisonment.  Each day upon which any such violation shall occur, shall constitute a separate offense.
   (B)   A person less than 21 years of age who violates this § 112.16(A) is liable for the following civil fines:
      (1)   For the first violation, a fine of not more than $25.
      (2)   For a second violation, a fine of not more than $50, or participation in substance abuse prevention services as defined in Section 6107 of Act 368 of the Public Acts of 1978, being M.C.L.A. § 333.6107, and designated by the administrator of substance abuse services, or both.
      (3)   For a third or subsequent violation, a fine of not more than $100, or participation in substance abuse prevention services as defined in Section 6107 of Act 368 of the Public Acts of 1978, and designated by the administrator of substance services, or both.
