§ 32.003  POLICY, PROCEDURES AND FUNCTIONS.
   (A)   The Mayor, City Clerk and City Attorney shall be appointed by the City Council for an indefinite period; each, individually, shall be responsible to and serve at the pleasure of the Council.
   (B)   All other administrative officers shall be appointed by the Mayor for indefinite terms of office.  Such officers shall be responsible to the Mayor and shall serve at his pleasure.
   (C)   Each administrative officer shall:
      (1)   Perform all duties required by the Charter, this subchapter, other laws and administrative orders, and he shall perform such other duties not in conflict therewith as may be assigned by the City Council or Mayor.
      (2)   Establish and maintain a system of accounts and reports in sufficient detail to furnish all information necessary for proper control of departmental activities.
      (3)   Have authority to delegate to employees coming under his direction such duties and responsibilities as deemed advisable, but in no case may he delegate his overall responsibility or any of his accountability.
      (4)   Have authority to appoint and remove, subject to applicable personnel laws and regulations, all subordinates under him.
      (5)   Be responsible for the proper maintenance and care of all city property and equipment under in his department.
   (D)   Mayor, Office of.
      (1)   Shall be the chief administrative officer of the city government and shall perform all the duties and have all the responsibilities enumerated by the Charter, general law and local ordinances and policies established by City Council.
      (2)   Shall, in exercising general control over the administrative affairs, of the general government of the city, deal insofar as it is practical through the administrative officers designated by this code, and except as otherwise provided by Charter or general law, shall have the sole power to appoint, supervise, suspend, remove and discipline all such officers, and to perform or delegate the duties and responsibilities of such officers.
      (3)   Shall authorize the employment of persons by the city government; maintain employee personnel records and certify payrolls as to compliance with personnel rules and procedures; assist administrative officers in the organization and conduct of training programs; and administer all personnel functions of the city.
      (4)   Attend all regular and special Council sessions unless officially excused.
   (E)   City Clerk, Office of.  The City Clerk’s Office, under the supervision of the City Clerk and subject to the provisions of the Charter, general laws and ordinances, shall:
      (1)   Serve as registrar of voters for the city, maintain all election records and have custody of all property in connection with elections.
      (2)   Issue such licenses and permits, as directed.
      (3)   Attend all regular and special Council sessions unless officially excused.
      (4)   Perform other duties as may be required by charter, general laws, local ordinances or the Council.
   (F)   City Attorney, Office of.  The City Attorney’s Office shall consist of a City Attorney and, when deemed expedient, assistant city attorneys appointed by the Council.  The City Attorney, subject to provisions of the Charter and general laws, shall:
      (1)   Prepare or review for legal correctness all ordinances, resolutions, contracts, bonds, franchises and other instruments to which the city is a party.
      (2)   Attend all regular and special Council sessions unless officially excused.
      (3)   Advise the Council, Mayor, all administrative officers and all boards and commissions, as to the legality of any actions or proposed actions.
      (4)   Be responsible for all prosecutions for violations of ordinances, unless the manager, with Council approval, otherwise provides.
      (5)   Represent the city in all legal proceedings in which the city is a party or has an interest, before any court or judicial administrative or other tribunal, unless the manager, with council approval, otherwise provides.
   (G)   Finance Department.  The Finance Department, under the supervision of the City Treasurer, shall perform all the duties prescribed by Charter, Section 6.13 and other sections of the Charter.
      (1)   Accounting.  Responsibility for the preparation and maintenance of all city fund books and records including budget and payroll accounting and reporting.
      (2)   Collections.  Responsibility for the collection and deposit of cash, tax billing, posting and reconcilement of taxes.
      (3)   Utilities billing.  Responsibility for preparing, accounting for, maintaining and reporting on all necessary records pertaining to utility billings.
      (4)   The Department shall perform related duties as assigned.
   (H)   Assessor Department.  The Assessor Department, under the supervision of the City Assessor, shall be responsible for:
      (1)   Discovering, listing and appraising all real and person property in the city for tax purposes.
      (2)   Establishing and keeping current and adequate records system pertaining to properties, evaluations and assessments.
      (3)   The assessor is to be Clerk of the Board of Review.
      (4)   Performing other functions as assigned.
   (I)   Police Department.  The Police Department shall be under the supervision of a Chief of Police who shall have control of the assignment of all members of the force and direction of the police work in the city.  The Chief of Police shall possess such powers and authority as are assigned by Charter, general law, city ordinances and the Mayor.  Within the Department shall be the following functional areas:
      (1)   Patrol and traffic.  Responsibility for motor and foot patrol units, routine investigations not assigned to the detective division, enforcement of all traffic ordinances and requisition, preservation of peace and order in the city and other duties as assigned.
      (2)   Detective. With responsibility for the investigation of crimes, prevention of crimes, youth guidance and juvenile services, the preparation of evidence for the prosecution of criminal cases, and other duties as assigned.
      (3)   Service.  Responsibility for the maintenance of police records, maintenance of all communications equipment, the central complaint desk, custody of property, the operation of detention quarters, and other duties as assigned.
   (J)   Fire Department.  The Fire Department, under the supervision of a Fire Chief, shall consist of such forces and platoons of permanent officers and men, and volunteer officers and men, as may be recommended by the Fire Chief and the Mayor and approved by the City Council. The Fire Chief shall have control of the assignment of all members of the force and direction of fire operations in the city. The function of the department shall be to:
      (1)   Enforce all laws regarding the inspection for and removal of fire hazards and the prevention of fires.
      (2)   Extinguish fires and protect life and property against fire.
      (3)   Maintain an emergency rescue operation.
      (4)   Perform other duties as assigned.
   (K)   Community Development Planning and Inspection Department.  The Community Development, Planning and Inspection Department, under the supervision of the Community Development Director who shall be the coordinating officer for all sections:
      (1)   Community Development Section. 
         (a)   Coordinate and supervise housing rehabilitation programs, community organizing activities, and the acquisition relocation program.
         (b)   Develop strategies for economic development, housing, and employment/training projects.
         (c)   Participate in determining approaches to and problems in upgrading and construction of residential and business buildings, development programs, and the like.
         (d)   Study and research federal and state funding programs to determine conditions and criteria for eligibility of city participation.
         (e)   Prepares applications for grants, loan programs, and the like, in conformity to requirements.
      (2)   Planning Section.
         (a)   Conduct special reports and studies relative to the city government.
         (b)   Make studies and conduct research relative to the development of the master plan.
         (c)   Investigate zoning matters and recommend necessary revisions in the zoning ordinance.
         (d)   Provide administrative services and act in an advisory capacity to the planning commission.
      (4)   Urban Renewal Section.  The urban renewal section, under the supervision of the community development director, shall be responsible for administering programs of the city to improve itself through the elimination of slums and blight and the removal of causes of slum and blighted areas, thereby preventing their recurrence.
   (L)   Parks and Recreation Department.  The Parks and Recreation Department, under the supervision of the parks and recreation director, shall:
      (1)   Plan, promote, organize and supervise a comprehensive municipal recreational program.
      (2)   Operate and maintain all city recreation facilities.
      (3)   Operate all city parks and parkways.
      (4)   Provide administrative services and act in an advisory capacity to the parks and recreation commission.
      (5)   Perform other duties as assigned.
   (M)   Public Service, Office of.  The Public Service Office, under the direction of the Public Service Director, shall be the supervising office for the following functional areas:
      (1)   Public Works Section. Responsible for:
         (a)   Constructing, maintaining and repairing all roads, streets, bridges, sidewalks and drains of the city as directed.
         (b)   Street lights, street signs and signals.
         (c)   Planting, maintaining and removing of all trees and brush on or affecting city property and authorizing the planting and removing of trees on private property.
      (2)   Water and Sewer Section. Responsible for:
         (a)   Installing, maintaining and operating all water distribution and service lines and facilities.
         (b)   Installing, maintaining and operating all sewage collection, pumping and treatment facilities and service lines.
         (c)   Reading, installing and maintaining water meters.
         (d)   Receiving and answering citizen complaints relating to water and sewer services.
      (3)   Central Support Section. Responsible for:
         (a)   Maintaining, storing, servicing and repairing of all city motor vehicles.
         (b)   Operating and maintaining all city buildings and grounds assigned to the department of the Mayor.
         (c)   Monitoring all city contractors in the performance of their contracts.
         (d)   Supervising the contractor in the collection and disposal of garbage and trash.
      (4)   Engineering Section. Responsible for:
         (a)   Providing technical engineering advice to all city departments and offices, reviewing engineering work done by consulting engineers.
         (b)   Performing other functions as assigned.
   (N)    Personnel Department.  The Personnel Director shall be responsible for:
      (1)   Overall management of the Personnel Department.
      (2)   Labor management.
      (3)   Personnel planning.
      (4)   Benefit administration.
      (5)   Establish and maintain a uniform system of job evaluation for consistent identification of job values within the city in relationship to management and employee concerns.
      (6)   Perform other duties as assigned by the Mayor.
   (O)    Administrative Services Department.  The Department of Administrative Services, under the supervision of the Director of Administrative Services, shall:
      (1)   Direct the city’s centralized purchasing division and all its functions.
      (2)   Identify the need for city-wide policies and procedures in all areas of city governments. Determine priorities, deadlines and standards for the implementation of these policies and procedures.
      (3)   Monitor the activities of all city departments to ensure compliance with relevant laws and uniform, consistent application of policies and procedures.
      (4)   Analyze and implement legislation relating departmental activities.
      (5)   Assist in the implementation of all city contracts.
      (6)   Participate in strategic and tactical planning.
      (7)   Benefit administration.
      (8)   Perform other duties as assigned by Mayor.
      (9)   Serve as acting Mayor in the absence of the Mayor.
      (10)   Assist in the coordination and application of federal, state and other grant funds to develop capital improvements and to sponsor community programs.
      (11)   Assist in formulating and analyzing, and meeting organizational and operational goals and objectives.
   (P)   Building Inspector, Office of.  The Office of the Building Inspector shall be responsible to and work under the supervision of the Office of the City Manager; and shall be the supervising and administrative office for the following section:
      (1)   The Building Section.  Performance of the following duties and functions:
         (a)   Issue and revoke permits for, and inspect the work involved in, all construction remodeling and other land-use projects for conformation with the city’s zoning, plumbing, electrical, building and housing codes.
         (b)   Provide administrative services and act in an advisory capacity to the Board of Zoning Appeals.
         (c)   Enforce such other related codes and issue such other licenses and permits as may be directed by ordinance of the City Manager.
         (d)   Performs other duties as assigned by the City Manager.
