(A) Water in excess of one foot permitted to accumulate and stand in any excavation below the surface of the ground whether as a result of surface excavating, quarrying, building or any other operation 24 hours after due notice in writing thereof by the Director of Public Services shall be a public nuisance. Such notice shall be forwarded by registered mail to the owner or owners and/or lessee, tenants, permit holder or persons in charge of or responsible for such excavation, provided, that if any or all of the aforesaid cannot be located such notice shall be posted upon the premises where such nuisance exists.

(B) It shall be the duty of the Director of Public Services within three days after giving of notice of such nuisance to proceed forthwith to abate the same by removing or causing to be removed such accumulated water from any excavation. The cost of abating said nuisance shall be forwarded to the owner or owners of said premises which if not paid at the expiration of 60 days shall be forwarded to the City Treasurer who shall proceed to assess the same against the property on the miscellaneous assessment roll.
