§ 152.06 REGULATIONS TO BE OBSERVED; PROHIBITIONS.
   Every permit holder hereunder shall observe the following regulations in addition to special conditions of his permit.
   (A)   No excavating, quarrying or ground surface excavation shall be made within ten feet of any public street or alley. However, where any excavating or quarrying shall be made adjoining or adjacent to any public street or alley or any building which shall be dangerous in the opinion of the Director of Public Services, then upon notice thereof by said commissioner the parties shall be required to shore up with timbers said excavation or otherwise make safe such dangerous condition.
   (B)   Water, snow or ice shall not be permitted to stand or accumulate in any excavation. Every licensee hereunder shall provide proper facilities for removing, pumping and/or draining, as the case may be, all excavations where snow, water or ice may accumulate within 24 hours after such snow, water or ice accumulates.
   (C)   Any excavation in excess of six feet in depth as a result of excavating or quarrying operations now existing or hereafter created shall be properly fenced with a woven wire of at least ten gauge wire, masonry, concrete or wood structure at least six feet high from the level of the ground. Where a watchman is stationed 24 hours a day to exclude trespassers from such premises excavated no fencing shall be required.
