It shall be unlawful for any person, firm or corporation, exclusive of governmental agencies, within the city, to engage in or carry on any excavating operations, as a result of which the ground is removed below the natural level, without a permit therefor issued by the city for each location or place where such operations are not contemplated. However, temporary excavations for building construction purposes shall not be deemed to be excavating or quarrying where such excavation is made under a building permit issued under the Building Code, and, no permit shall be granted for excavating or quarrying operations as a commercial business in any area zoned as residential.
