§ 12.15.06. FAILURE TO PAY CODE ENFORCEMENT COSTS.
   The failure of any person to pay code enforcement cost assessment by the deadline specified in the written notice shall result in the assessment of an additional late fee. The amount of the late fee shall be established by the City Council.

§ 12.15.07. COLLECTION OF CODE ENFORCEMENT COSTS.
   The enforcement official shall collect the assessed code enforcement costs and late fees by the use of all appropriate legal means, including but not limited to referral to the City Finance Department or City Attorney for collection or by lien or special assessment pursuant to Division 13.

§ 12.15.08. PAYMENT TO CODE ENFORCEMENT CIVIL PENALTIES AND COST RECOVERY FUND.
   All code enforcement costs and late fees recovered shall be remitted to the City Finance Director who shall credit the appropriate amount to the code enforcement civil penalties fund provided for in Division 16, or alternatively use the monies to reimburse the department responsible for the subject code enforcement action where appropriate.

DIVISION 16. CODE ENFORCEMENT CIVIL PENALTIES AND COST RECOVERY FUND
§ 12.16.01. DECLARATION OF PURPOSE.
   The City Council finds that there is a need to create and maintain a funding source for the administration and operation of code enforcement activities in the city. In order to effectively administer such activities as nuisance abatement, inspections and re-inspections, imposition of liens and special assessments on real property, administrative hearings related thereto, departmental code enforcement cost reimbursement, and other activities to enhance and improve code enforcement for the public safety and welfare, the establishment of a code enforcement civil penalties and cost recovery fund is essential.

§ 12.16.02. ESTABLISHMENT OF CODE ENFORCEMENT CIVIL PENALTIES AND COST RECOVERY FUND.
   There shall be established a code enforcement civil penalties and cost recovery fund which shall be administered by the Finance Director and shall consist of all monies collected by the imposition of fines, civil penalties, nuisance abatement recovery monies and all other costs and reimbursements recovered by code enforcement actions.

§ 12.16.03. USE OF FUNDS.
   All funds collected from code enforcement actions shall be deposited into a separate fund and used for the supplemental financing of code enforcement programs or, where appropriate, to reimburse the department responsible for the subject code enforcement action.
