§ 162.440 GRADING OPERATION - HOURS PERMITTED.
   Grading and equipment operations within one-half mile of a structure for which city has issued a certificate of occupancy shall not be conducted except during the hours specified in § 151.160 of this code as permissible for work of construction, erection, alteration, repair, addition to or improvement of any building, structure, road or improvement to realty. No owner shall engage in grading or equipment operations pursuant to this chapter during other hours without approval of the City Council. With City Council approval, the Director of Public Works may permit grading or equipment operations during other specific hours if the Director determines that such operations are not detrimental to the health, safety or welfare of the inhabitants of such a structure. Permitted hours of grading and equipment operations per this § 162.440 may be shortened by the Director of Public Works' finding of a previously unforeseen effect on the health, safety or welfare of the surrounding community. Work approved to be performed other than during the hours permitted by this § 162.440 shall require an amendment to the grading permit and payment of additional fees to cover necessary inspection of same.
