(A) Any person or entity claiming to be aggrieved by a final action of the MSD on a detailed EPSC plan may appeal such action to the MSD Board. Such appeals shall be taken within 30 days of the final action taken by the MSD in § 156.030(E) for Type I reviews, or within 30 days of the final action taken by the MSD in § 156.031(B) for Type II reviews, by filing with the secretary of the MSD Board a notice of appeal specifying the grounds thereof. Any final action not appealed within 30 days of such action shall be considered final and unappealable.
(B) Appeals from action of the MSD Board on detailed EPSC plans shall be taken to a state court of competent jurisdiction pursuant to applicable state statutes.
