At the time of the subdivided release from guaranteeing proper functioning of required improvements pursuant to § 155.215, each builder is required to post with the Director of Works and/or the MSD a builder’s bond prior to the issuance of the building permit to ensure the fulfillment of the obligations set out in § 155.216 and to ensure compliance with the tree canopy requirements and sidewalk requirements in accordance with §§ 155.120 through 155.127. The bond shall be in the amount of $2,500 or an appropriate amount as determined by the Director of Works, the Director of Planning, and/or the MSD. In the event a building permit has been issued on unimproved lots that are sensitive to generation of drainage related damages to existing development at the time of release of the subdivided performance bond, a $2,500 bond or an appropriate amount shall be posted on those lots by the builder. UNIMPROVED LOTS refers to those on which no primary building has been constructed.
