§ 154.26 EXEMPTIONS.
   (A)   This subchapter is not intended to prohibit children’s wading pools of not more than six feet in diameter and not more than 12 inches in depth; however, it is intended to apply to any other construction on a lot intended to contain water, whether it be known as a pool, a pond, or by some other name.
   (B)   As an alternative to the security fence required by § 154.20(D), the pond or other open water encompassed by this section may be secured by a grate or other similar cover located at or immediately below water level. To the extent such alternate is not feasible, a variance may be requested from the City Council.
