§ 154.047 STANDARDS FOR VARIATIONS INVOLVING MAJOR SUBDIVISIONS OF NEIGHBORHOOD SIZE.
   Where a major subdivision large enough to constitute a self-contained neighborhood is proposed with a comprehensive plan for the site and, in the judgment of the Commission, such comprehensive plan makes adequate provisions for essential community requirements and proposes reasonable modifications to the standards of this chapter to accommodate the unusual size of the subdivision, the Commission may grant variations to the regulations of this chapter by making findings of fact based upon the evidence presented to it which support written conclusions that:
   (A)   The conditions upon which the request for variation is based are unusual to the property for which each variation is sought and are not applicable generally to other property;
   (B)   The purpose of the requested variation is not based exclusively upon a desire to obtain additional income from or add value to the property;
   (C)   The granting of the requested variation will not be detrimental to the public health, safety or general welfare or injurious to other property or improvements in the neighborhood in which the property is located, nor conflict with the village's adopted land use plan;
   (D)   The special circumstances or conditions are created by the provisions or requirements of this chapter and have not resulted from any act of the applicant or applicant's predecessor in interest;
   (E)   Each variation requested is the minimum adjustment necessary for the reasonable use of the land; and
   (F)   The variation requested will not conflict with the general purpose and intent of this chapter.
