§ 92.99 PENALTY.
   (A)   Any person who shall violate any of the provisions of the fire prevention code, as adopted and enacted into law, or fail to comply therewith, or that shall violate or fail to comply with any order made thereunder, or that shall build in violation of or noncompliance with any detailed statement of specifications or plans submitted and approved thereunder, or any certificate or permit issued thereunder and from which no appeal has been taken, or that shall fail to comply with any order that is affirmed, or any order as modified, upon appeal to a court of competent jurisdiction, within the time fixed in the order severally for each and every violation or noncompliance be fined not less than $25 nor more than $100. When not otherwise expressly provided, each ten days that violations, noncompliances, or prohibited conditions continue, whether before or after the imposition of a penalty therefor under this chapter, shall constitute a separate offense.
   (B)   The imposition of a penalty under this chapter shall not be held to prevent the forced removal or elimination of prohibited conditions.

   (C)   (1)   Whoever causes or allows burning in violation of § 92.05 shall be fined not less than $5 nor more than $25 per day of burning plus the cost of proper disposal of the materials burned. Whoever causes or allows open burning in a second or subsequent violation of § 92.05 shall be fined not less than $25 nor more than $50 per day of burning plus the cost of proper disposal of the materials burned.
      (2)   The cost of proper disposal of the materials burned shall be the amount it would have cost to dispose of the materials in a manner that is consistent with the air, water, and solid waste laws, ordinances, and regulations of the village and the state.
