§ 51.37 SERVICE BRANCH REGULATIONS.
   (A)   When a service branch and water meter is installed, so much of the branch as is in the highway to the front lot line shall be installed by the Department but shall be paid for by the property owner at the time of the application for water service, the payment to be as established by ordinance. Except in cases where service branches are installed for vacant property in connection with highway improvements, applications for service branch installations shall be accompanied by application for meters which shall also be paid for at the time of the application.
      (1)   Only metered water service branches shall be permitted.
      (2)   Branches installed for fire protection shall be subject to "Engineering and Plumbing Requirements" provided that a branch for any principal building hereafter constructed shall be provided with one fire hydrant for every 500 feet of the branch to be no less than eight inches in diameter.
      (3)   Application for water service shall be made by the owner of the premises to be supplied, or by his or her authorized agent. Water will be turned on by an authorized employee of the Department after the application has been duly filed at the village office.
      (4)   No application for water service will be allowed or no water shall be supplied to any applicant or consumer where the applicant or consumer is indebted to the Department for water supplied, work done, materials furnished or penalties imposed. This section will apply whether the indebtedness was incurred at the premises for which application is made or at any other premises supplied by the Department within or without the village limits.
   (B)   No permit for the erection of a building shall be approved by the City Manager unless an application for a service branch has been made, or an application for meter has been made in cases where the service branch has previously been installed.
   (C)   No water service branch shall at any time be laid in the same trench with a sewer connection, electrical supply cable or telephone cable.
   (D)   Where any parcel of property is supplied through two or more connecting service branches each branch shall be equipped with a check valve so set that water can flow into and not out of the premises and each service branch shall be equipped with a separate meter.
   (E)   Water service branches shall be the property of the owners of the property served by them and that portion of the service branch from the curb cock into the premises served shall be maintained in proper condition by the owners. Failure to repair a leak or leaks when notified of same within the time allowed on the notice shall be sufficient cause to justify the Department in discontinuing water service.
   (F)   No connection into more than one building shall be made from one tap unless the Superintendent has given his or her approval in writing.
   (G)   No attachment shall be made to any service branch or to any pipe or other fixture which has been shut off pursuant to this operating code or order of the Superintendent without first having obtained a permit upon application duly made, nor shall water be taken from any service branch which is or has been out of use without such a permit.
   (H)   The original purchase of a meter shall be made by the consumer but after it has been installed and placed in service, the Department will assume the maintenance of the meter or its replacement without charge to the consumer, except that in cases of damage by freezing, hot water, or other neglect on the part of the consumer, the cost of repairs or replacement shall be charged to the consumer.
   (I)   Meters shall be fully and substantially set in a workmanlike manner and in accordance with the "Engineering and Plumbing Requirements". Meters hereafter installed shall be placed in a frost-proof meter box or pit, plans for which may be obtained from the Department, and shall be placed at the front lot line.
   (J)   The Superintendent and authorized employees of the Department shall have the right at reasonable times to enter any premises where a meter is installed for the purpose of reading, examining, inspecting, or testing the same. The Superintendent shall be authorized to fix reasonable charges for the removal, examination, inspection, testing, and reinstating meters upon application of the consumer.
   (K)   Meter and service branch charges as set forth in the Appendix following this chapter, are hereby adopted and shall be effective January 1, 2018. System customers who increase the size of their meter and service branches shall be responsible for paying a fee equal to the difference in cost between their present service size and the increase service size as set forth in the Appendix.
   (L)   There are hereby established Capital Improvement Debt Service Fees for the purpose of paying a portion of the cost of capital improvements to the Water Works System and the costs associated with the financing of said improvements. Said fees shall be in addition to meter and service branch fees specified under division (K) of this section and shall be deposited in the Water Works Capital Improvement Reserve Fund. These fees shall be applicable to all new water system taps made within the Water Works System service area and shall be in the amounts specified below:
