§ 36.42 EXPENDITURES FROM ARBORETUM FUND.
   The Manager is empowered to make expenditures from the Arboretum Fund as the care, maintenance and improvement of the Stanley M. Rowe Arboretum is required; provided however:
   (A)   The excess income from the fund not used for maintenance, upkeep and repair of the Arboretum shall be accumulated in the fund to the extent deemed necessary by the Council for the village and the balance may be used for the maintenance, upkeep and repair of the other green areas within the village.
   (B)   If there are excess funds, either income and in the judgment of the Council excess principal, the excess income and/or the excess principal may be used to purchase additional property for Arboretum purposes and it is requested that such use be made of such funds, but if not so used, shall nevertheless be used for green area purposes.
