In order to ensure that emergency measures could be taken by the Village of Indian Hill if the soil erosion and sediment control measures were not implemented and maintained according to the agreed upon plan and schedule, a performance bond in the amount of the cost of the soil erosion and sediment control measures shall be required. In this regard, the plan shall be accompanied by written instructions to the escrow holder which shall instruct the escrow holder to: convey to the Village of Indian Hill or its designee the cash guarantee upon recommendation of the Planning Commission that emergency action by the Village of Hill is required to complete the provisions of the plan, or convey to the applicant upon approval, by recommendation of the Planning Commission the satisfactory completion of the plan.
