§ 152.34 PRELIMINARY PLAT - FINAL APPROVAL (Stage 2)(Mandatory)
   Final approval of the Preliminary Plat under this Section shall confer upon the proprietor for a period of two (2) years from the date of approval, the rights granted under Section 120 of the Land Division Act. The two (2) year period may be extended if applied for by the proprietor and granted by the City Commission in writing. Written notice of the extension shall be sent by the City Commission to the other approving authorities.
   (A) Submittal: A complete application containing all of the required information in Section 152.31 shall be submitted.
      (1)   The proprietor, upon receiving tentative approval from the City Commission, shall submit the Preliminary Plat to all authorities as required by Sections 113 to 119 of the Land Division Act, Act 288, Public Acts of 1967, including but not limited to:
         a.   Lapeer County Road Commission (for approval or rejection).
         b.   Lapeer County Drain Commission (for approval or rejection).
         c.   Michigan Department of Transportation (for approval or rejection)
         d.   Michigan Department of Natural Resources (for approval or rejection)
         e.   Michigan Department of Public Health and/or Lapeer County Health Department (for approval or rejection)
         f.   Lapeer County Plat Board (for informational purposes)
         g.   All public utilities serving the area (for informational purposes)
      (2)   Prior to expiration the tentatively approved Preliminary Plat shall be submitted by the proprietor in fifteen (15) copies to the Planning Commission for review and recommendation to the City Commission. The City Clerk shall distribute copies to the following:
         a.   Planning Commissioners
         b.   City Planner
         c.   City Engineer
   (B)   Review Procedures: The City Commission, after receipt of the necessary approved copies of the Preliminary Plat shall:
      (1)   Consider the review and recommendations of the City Engineer, City Planner and City Planning Commission for compliance with the tentative approved Preliminary Plat standards.
      (2)   Consider the Preliminary Plat at its next meeting or within thirty (30) days from the date of the submission of all necessary approved plats, application and fee.
      (3)   If the Preliminary Plat conforms substantially to the plat approved tentatively by the City Commission and has met all conditions specified for tentative approval, then the City Commission shall give final approval to the preliminary-plat.
      (4)   Instruct the City Clerk to promptly record on the copy of the Preliminary Plat to be returned to the proprietor the approval or rejection with reasons for any rejection.
