If, at any city election, there shall be no choice between candidates by reason of two (2) or more persons having received an equal number of votes, then the Commission shall name a date for the appearance of such person for the purpose of determining the election of such candidate by lot as provided by state law. Should any person or persons fail or refuse to appear, in person or by representative, to determine the result of any tie election at the time and place named by the Commission, such determination shall be made by lot in his or their absence and under the supervision of the Commission. Such determination shall, in any event, be final.
