§ 50.03 COLLECTIONS.
   Garbage containers shall be emptied and the contents disposed of in a sanitary manner at least once each week, or the contents shall be picked up once each week by a garbage collector contracted and licensed by the city.
   (A)   Bundled brush. Brush such as minor tree limbs, twigs and lumber not exceeding four feet in length and a diameter of more than four inches may be bundled together and securely tied and if the bundle does not exceed 50 pounds, the same can be placed with the refuse for collection or may be placed in a container for collection with other refuse. The bundles shall not contain nails or other sharp protruding objects which could cause damage to the collectors of such refuse.
   (B)   It shall be the responsibility of all persons to have said refuse at the point of collection by 7:00 a.m. of the day specified and all persons are prohibited from depositing the refuse for collection prior to 7:00 a.m. of the preceding morning. These hours may be modified by resolution of the City Commission. Failure to comply with these time requirements shall not result in criminal penalties.
   (C)   In the event that the city or the hauler or collector of refuse has a legal holiday on the date of collection, then the refuse will be collected the following day excluding holidays and Sundays, unless published in the local newspaper to the contrary.
   (D)   It shall be unlawful for any person, firm, partnership, corporation, or association or business entity of any type to collect or haul refuse deposited for collection under this chapter unless the same are city employees or persons who are authorized to make such collections. The hauler or collector shall be responsible for any act or omission or commission which results in the discharge of any contents of such vehicle upon the streets, alleys, and other private or public places in the city and it shall be the driver's duty to forthwith remove from any such street, alley or public or private places in the city any refuse which has been so discharged.
