(A) It is unlawful for any person to construct or maintain an excavation on private property or public property which is not owned or under the control of the city, without a written permit from the city.
(B) All applications for a permit shall be made on forms furnished by the city, and all permits shall be issued on conditions as will protect persons and property from damage or injury.
