1333.10 HEARING BEFORE PLANNING AND ZONING COMMISSION.
   (a)    The Planning and Zoning Commission shall schedule a hearing on all violations of this chapter reported by the Building Inspector, the time and place of which shall be included in the notice to the owner as provided in Section 1333.09.
   (b)    In passing on said violations, the Planning and Zoning Commission shall require submission of evidence to substantiate all claims and may require such additional data as, in the opinion of the Commission, are needed for adequate consideration of violations. Any member of the Commission or any person authorized by the Commission may at any reasonable time enter, inspect and examine any dwelling or structure for the purpose of carrying out the duties of the Commission.
   (c)    The Planning and Zoning Commission shall in every case reach a decision without unreasonable or unnecessary delay. Every decision of the Commission shall be in writing, dated, indicate the vote upon a decision, and promptly filed in the office of the Building Inspector. A certified copy of the decision shall be sent by certified mail to the owner, return receipt requested, and a copy shall be publicly posted in the office of the Building Inspector for two weeks after mailing.
   (d)    If the Planning and Zoning Commission shall determine that the owner is in violation of this chapter, its decision shall specify the particular sections of this chapter which have been violated and shall give the owner a reasonable time to complete specified repairs or improvements or to demolish and remove the dwelling or structure or a portion thereof. The decision shall also advise the owner that he or she is entitled to a hearing before Council, if he or she requests it by filing a notice of appeal with the Planning and Zoning Commission within thirty days of the date of the Commission's decision.
