If the Planning and Zoning Commission denies the application, the applicant or owner may appeal to Council by filing a written notice of such appeal with the Clerk of Council within thirty days from the date of the mailing of the notice to the applicant and the owner, as provided in Section 1325.03. The Clerk of Council shall then obtain from the Planning and Zoning Commission the application, reports, recommendations, documents and minutes, or copies thereof, relating to the application and the action taken thereon by the Planning and Zoning Commission and submit the same to Council. Council, by a two-thirds vote, may approve the application, with the same conditions as set forth in Section 1325.02, as it deems necessary.
