(A) Products containing synthetic cannabinoids such as "K-2"/"Spice" or similar products ("products") which contain one or more of the following chemical compounds:
(1) 2-[(lR,3S)-3-hydroxycyclohexyl]-5-(2-methyloctan-2-yl) phenol [also known as CP 47,497 and its C6, C7, C8, and C9 homologues];
(2) (6aR,10aR)-9-(hydrosymethyl)-6,6-dimethyl-3-(2 methyloctan-2-yl)-6a,7,10,10a-tetrahydrobenzo [c]chromen-1-ol [also known as HU-210];
(3) Naphthalen-1-yl-(l-pentylindol-3-yl)methanone [also known as 1 Pentyl-3-(l-naphthoyl)indole or JWH-018];
(4) Naphthalen-1-yl-(1-butylindol-3-yl)methanone [also known as 1-Butyl-3-(1-naphthoyl)indole or JWH-073];
shall not be sold, marketed or offered for sale within the City of Huntington, Indiana.
(B) This section shall be enforced by the city Police Department.
(C) Any of the products defined in § 133.04(A) may, if found to be in violation of this section, be seized by the city Police Department. Any products so seized shall be held by the city Police Department and thereafter disposed of only upon court order or pursuant to and in compliance with the provisions of the Indiana Code pertaining to the disposition of seized evidence.
(D) Persons or entities violating the provisions of this section shall be subject to the penalty imposed by law for a Class B Infraction as set forth in IC 34-28-5-4.
(E) This section shall be enforced pursuant to IC 34-28-5.
