(A) The municipality shall have the right to plant, prune, maintain, and remove street trees or park trees within the lines of all streets, alleys, avenues, lanes, squares, and public grounds as may be necessary to ensure public safety or to preserve or enhance the symmetry and beauty of public grounds.
(B) The City Tree Board may remove or cause or order to be removed any street tree or park tree or part thereof which is in an unsafe condition or which by reason of its nature is injurious to sewers, electric power lines, gas lines, water lines, or other public improvements, or is affected with any injurious fungus, insect, or other pest.
(C) No person or property owner shall remove any live street tree or park tree for any reason without written permission of the City Tree Board. Utility companies may remove trees or parts thereof which are injurious to their utility lines at their expense upon obtaining permission for the removal or trimming from the City Tree Board. This section does not prohibit the planting of street trees by abutting property owners, provided that the selection and location of the trees is in accordance with §§ 97.02 through 97.06.
