(A) Intent. It is the intention of the City Council and it is hereby ordained, that the provisions of this section shall become and be made part of this traffic code, and the divisions of this section may be renumbered to accomplish that intention.
(B) Definitions. For the purpose of this section, the following terms, phrases, words, and their derivations shall have the meaning given herein. When not inconsistent with the context, words used in the present tense include the future, words in the plural number include the singular number, and words in the singular number the plural number. The word SHALL is always mandatory and not merely directory.
CITY. The City of Humboldt, Nebraska.
ENGINE BRAKE. A device that converts a power producing engine into a power-absorbing air compressor, resulting in a net energy loss.
(C) Prohibition. The use of engine brakes is prohibited in the corporate limits of the city.
(D) Violation. Any person violating the provisions hereof shall be penalized under the provisions of the general penalty section, § 10.99.
