838.01 PERMIT REQUIRED; FEE; AUTHORITY OF PLANNING COMMISSION.
   No drilling operation for the exploration of gas and/or oil which exceeds a penetration of greater than fifty feet from site-grade level shall be commenced until a drilling permit is obtained from the Municipality. A separate permit is required for each gas and/or oil well. A nonrefundable fee of one thousand dollars ($1,000), payable to the Municipality to cover the costs of application review, shall be submitted with the permit application.
   (a)   The Planning Commission shall schedule and advertise a public hearing to give adjoining property owners and citizens an opportunity to obtain information from the applicant regarding the location of wells, equipment, roadways, dates of drilling, and safety and health precautions.
   (b)   The Planning Commission shall schedule and advertise a public hearing whenever a tank battery or other producing equipment has to be relocated.
