(a) No person shall equip or operate a motorcycle so as to create unnecessary noise and destroy the peace of the City. In addition to any other penalty, any motorcycle equipped or operated in violation of this section shall be impounded by the Police Department as material evidence and returned to the owner upon the conviction or acquittal of the operator.

(b) Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
