(a) No owner, occupant or other person having control of the ground under utility wires or of the property abutting such ground shall plant or permit to be planted on such ground any tree which grows over twelve feet in height.
(b) Any tree planted in violation of subsection (a) hereof shall be removed at the expense of such owner, occupant or person having control. Such remedy shall be in addition to the penalty provided in Section 909.99.
