§ 70.33 TRAFFIC REGULATION IN PUBLIC AND PRIVATE PLACES.
   (A)   Private shopping center parking lots conducted for commercial purposes or in conjunction with any business enterprise, all other public or private parking lots, and all other public and private properties used by the public for pedestrian or vehicular traffic and parking, are hereby declared to be affected with a public interest. These properties affected with a public interest, to the extent allowable by law, shall be subject to the following traffic and parking regulations.
   (B)   (1)   All traffic regulations, applicable to drivers of vehicles or bicycles or to pedestrians, enumerated in M.S. Chapter 169, as it may be amended from time to time, as of the date of enactment of this section, (hereafter referred to as Minnesota Traffic Code), are hereby made applicable to the properties affected with a public interest as enumerated in division (A) above within the city, and violation of the statutes which are hereby incorporated by reference into this section shall be a violation of this section. All regulations enumerated in the Minnesota Traffic Code shall be applicable herein whether the statutes, by their terms, apply solely to public streets and highways, or apply to private property. Any person violating any statutory regulation which applies to the properties affected with a public interest as enumerated in division (A) above may be charged with either violation of the statute or with violation of this section.
      (2)   The traffic regulations herein established shall be in addition to all state statutes or city ordinances applying to those properties affected with a public interest as enumerated in division (A) above. This section shall not be construed so as to amend or revoke any other regulations clearly applicable to the properties affected with a public interest as enumerated in division (A) above. If any traffic regulations contained in this section shall be adjudged void or of no affect, for any reason whatsoever, the decision shall not affect the validity of any of the other traffic regulations contained herein, or contained in other ordinances or state statutes.
   (C)   The Police Department, with the approval of the City Council, and with the written consent of the owner where private property is concerned, may establish the maximum speeds at which vehicles and bicycles may be driven in private or public parking lots and may establish the location of, and the direction of travel, of driving lanes within the parking lots. The speed limits and driving lanes shall be based on the requirements of safety in the parking areas affected. Each speed limit and driving lane regulation shall be established in writing, filed with the City Clerk-Treasurer, published once in the official newspaper, and shall become effective thereafter as an absolute speed limit and driving lane regulation on being sign posted at each entrance to the shopping center parking lot and along the driving lanes. No person shall drive a vehicle or bicycle on the parking lot at a speed in excess of the limits established, or in violation of any driving lane regulation.
   (D)   (1)   Emergency vehicle lane. The Police Department with the approval of the City Council, and with the written consent of the owner where private property is concerned, may designate an area on a public or private parking lot as an emergency vehicle lane. Signs shall be posted at any entrance to the area to identify the area as an emergency vehicle lane and to prohibit parking or stopping of vehicles therein. The emergency vehicle lane designation shall be established in writing, filed with the City Clerk- Treasurer, published once in the official newspaper, and shall become effective as an absolute parking regulation on being sign posted at each entrance thereof. No person shall stop or park his or her vehicle on any area designated as an emergency vehicle lane except ambulances, Police Department vehicles, Fire Department vehicles and other emergency vehicles.
      (2)   Loading zone. The Police Department with the approval of the City Council, and with the written consent of the owner where private property is concerned, may designate areas of the parking lots as a loading zone, and prohibit parking during specified hours, except for purposes of loading and unloading goods and merchandise to or from places of business or storage. The loading zone designation shall be established in writing, filed with the City Clerk-Treasurer, published once in the official newspaper, and shall become effective thereafter as an absolute parking regulation on being sign posted at each end of the area. No person shall stop or park his or her vehicle in the areas during the specified hours except for the sole purposes of loading and unloading.
      (3)   General parking regulations. Stopping or parking of vehicles in parking lots shall be limited to those areas designated as parking areas by signs, lines painted on the surface of the parking lots, or in even horizontal lines of vehicles which allow free access to enter or leave the parking areas. Parking or stopping of vehicles is prohibited in any driving lane or in any area which is used for the flow of traffic entering and leaving the parking lots, or in any area which unduly obstructs the flow of traffic therein.
