(A) The City Council finds that there is rising concern about conserving valuable resources. The City Council further finds that sprinkling lawns during the middle of the day is wasteful and may be harmful. Accordingly, it is in the public interest to prohibit lawn sprinkling during midday hours, and to regulate and restrict lawn sprinkling and other nonessential water use.
(B) The following mandatory water conservation measure is hereby established on a year-round basis. Lawn watering and garden watering is limited between 6:00 a.m. and 10:00 a.m., and between 6:00 p.m. and 10:00 p.m., with watering on even-numbered days at those residences with even- numbered addresses, and on odd-numbered days at those residences with odd-numbered addresses. Watering exceptions shall be allowed by the Public Utilities Supervisor, or his or her designee, for newly seeded lawns, new sod and where necessary to keep other plants alive.
(C) Whenever water production reaches 574,000 gallons per day for three consecutive days, the city shall implement additional mandatory water conservation measures which shall include the following: nonessential water uses such as washing motor vehicles, boats, trailers or other vehicles, exteriors of dwellings, buildings or other structures; and washing of sidewalks, driveways and other hard-paved areas, shall be limited to odd-numbered addresses on odd-numbered days, and even-numbered addresses on even-numbered days. The Public Utilities Supervisor, or his or her designee, shall publish notice of the mandatory water conservation requirements in the legal newspaper, and those other publications as determined by City Council resolution, and the mandatory water conservation measures shall take place immediately upon the publication.
(D) Whenever water production reaches 826,000 gallons per day for three consecutive days, the city shall implement a mandatory water conservation measure, which shall include the following: watering of lawns and gardens shall be prohibited; all other nonessential water uses, such as washing motor vehicles, boats, trailers, or other vehicles, exteriors of dwellings, buildings or other structures; and washing of sidewalks, driveways, and other hard-paved areas, shall be prohibited. Watering exceptions shall be allowed by the Public Utilities Supervisor, or his or her designee, for newly seeded lawns, new sod and where necessary to keep other plants alive. The Public Utilities Supervisor, or his or her designee, shall publish notice of the mandatory water conservation requirements in the legal newspaper, and those other publications as determined by City Council resolution and the mandatory water conservation measures shall take place immediately upon the publication.
(E) In addition to the above requirements, whenever the City Council determines that a shortage of water supply threatens the city of otherwise determines it is in the public interest to restrict the nonessential water use, the City Council may, by resolution, impose the mandatory water conservation measures as set forth above. The Public Utilities Supervisor, or his or her designee, shall publish notice of the mandatory water conservation requirements in the legal newspaper, and those other publications as determined by City Council resolution and the mandatory water conservation measures shall take place immediately upon the publication. In addition, if the emergency requires immediate compliance with the terms of the resolution, the City Council may provide for a delivery of a copy of the resolution to the premises of water customers, in which case the regulations shall be effective immediately following the delivery.
