§ 51.03 DISPOSAL REQUIRED.
   Every person shall, in a sanitary manner, store and dispose of refuse, sewage and construction materials that may accumulate upon property owned or occupied or used by the person in accordance with the terms of this subchapter. Refuse shall be collected or otherwise lawfully disposed of at least once every week. Every householder, occupant and owner of any residence shall use the refuse collection service provided by the city. Further, every owner or occupant of a business or commercial establishment within the developed area of the city shall use the refuse collection service provided by the city. In the event that an owner or occupant of a residence, or business or commercial establishment has special circumstances that require or justify a special or different method of disposal of refuse, sewage or building materials, the owner or occupant may apply for a variance from this requirement to the City Council. A variance may be granted, but only upon a showing that the owner or occupant shall adequately and properly dispose of same in compliance with the regulations contained within this subchapter, and further, upon payment of those fees as the City Council determines by resolution for use of the landfill.
