§ 90.04 RESTRAINT.
   All dogs and cats shall be kept under restraint, as provided in this section.
   (A)   (1)   In the following areas of the city, all cats and dogs must be under leash restraint and accompanied by a responsible person:
         (a)   Beach;
         (b)   Playgrounds;
         (c)   Business areas with buildings intended for business or other commercial purposes;
         (d)   Residential areas with buildings intended for residential purposes;
         (e)   Recreational areas including softball fields, Water Carnival midway and golf course, while a recreational event is in progress;
         (f)   Designated walking trail located in Fisherman’s Point Campground or Whitewater Lake back bay; and
         (g)   Fisherman’s Point Campground during the season that the campground is open, except as provided in division (B)(3) below.
      (2)   In the areas described above, verbal restraint or electronic restraint is not sufficient and shall be a violation of this chapter.
   (B)   In the following areas of the city, all cats and dogs must be under leash restraint, vocal restraint or electronic restraint, and accompanied by a responsible person:
      (1)   All designated walking trails other than as described in division (A) above;
      (2)   All areas within the city zoned residential, business or commercial, except as set forth in division (A) above; and
      (3)   In Fisherman’s Point Campground, within the boundary of a specific campsite rented by the owner of the cat or dog.
   (C)   Within the city limits, dogs or cats are not required to be under restraint, as defined by this chapter, except as set forth in divisions (A) or (B) above.
   (D)   The provisions of this section require all dogs and cats to be under the effective control of a responsible person. It is a violation of this chapter if a dog or cat is not under a responsible person’s effective control, even if the dog or cat is connected to a leash, wearing an electronic collar or in the vicinity of the person, and not under the person’s effective control.
