In the event that a property owner fails to provide evidence reasonably satisfactory to the city council as required in subsection 9-15-8C of this chapter, the city council shall hold a public hearing in accordance with this chapter to consider terminating or modifying the development agreement.
A. Notice; Hearing: The city council shall provide the property owner notice and reasonable opportunity to be heard concerning the matter and a public hearing shall be conducted.
B. Written Decision: Within ten (10) calendar days of the completion of the hearing, the city council shall issue a written decision taking no action, terminating the development agreement or modifying the development agreement. (Ord. 224, 8-13-2008)
