§ 130.09 OPEN DISPLAY OF CERTAIN EXPLICIT SEXUAL MATERIALS PROHIBITED.
   (A)   For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      DISPLAY FOR SALE. Display in an area to which minors have access; display where minors are able to see it.
      MATTER. Any book, magazine, newspaper or other printed or written material or any picture, drawing, photograph, motion picture or other pictorial representation or any statue or other figure, or any recording transcription or mechanical, chemical or electrical reproduction or any other articles, equipment, machines or materials.

      MINOR. A person less than 18 years of age.
      OBSCENE.
         (a)   To the average person, applying contemporary community standards, the predominant appeal of the matter, taken as a whole, is to prurient interest in sexual conduct;
         (b)   The matter depicts or describes the sexual conduct in a patently offensive way; and
         (c)   The matter, taken as a whole, lacks serious literary, artistic, political or scientific value.

      PUBLIC DISPLAY. The placing of material on a newsstand, display rack, window, showcase, display case or similar place so that matter bringing it within the definition of "explicit sexual material" is visible from public viewing.
   (B)   A person is guilty of a violation of this section if he or she displays explicit sexual material for sale in an area to which minors have access, or if he or she fails to take prompt action to remove such a display from property in his or her possession after learning of its existence.
