§ 95.02 LEAVING ABANDONED OR JUNKED VEHICLE PROHIBITED.
   (A)   Abandonment of vehicles. No person shall abandon any vehicle within the city and no person shall leave any vehicle at any place within the city for such time and under such circumstances as to cause the vehicle reasonably to appear to have been abandoned.
   (B)   Leaving of wrecked, nonoperating vehicle on street. No person shall leave any partially dismantled, nonoperating, wrecked or junked vehicle on any street or highway within the city.
   (C)   The presence of any junk vehicle, related refuse or rubbish from the vehicles or vehicle parts, on any lot or parcel of land, public or private, within the territorial limits of the city, shall be deemed a public nuisance. However, an abandoned vehicle must be abandoned for a period in excess of ten consecutive days unless it becomes hazardous due to its location. It shall be unlawful for any person to cause or maintain such a public nuisance by keeping, storing, placing or allowing these items to remain in open view. The use of tarps or any other type of vehicle cover to hide and/or cover any junked or abandoned vehicle in open view shall not remedy the requirement that any such vehicle is to be removed from open view. The owners or occupants of any such lot or parcel of land or other person maintaining or permitting any such nuisance, shall jointly and severally abate the nuisance by prompt removal of the offending object into completely enclosed buildings within the territorial limits of the city or to a location outside the territorial limits of the city.
   (D)   Exceptions and exemptions. The following items are excepted and exempted from compliance with the provisions of § 95.02.
      (1)   Any vehicle on the premises of a business enterprise operating in a lawful manner and having obtained the requisite occupational license under Chapter 110 of the Hopkinsville Code of Ordinances to engage in its business; provided:
         (a)   The vehicle is necessary to the operation of an enterprise dealing in motor vehicles, so long as no more than 12 junk vehicles are present;
         (b)   The enterprise is a motor vehicle junkyard that has satisfied Chapter 158 of the Hopkinsville Code of Ordinances. However, nothing in this section shall authorize the maintenance of a public or private nuisance as defined under other provisions of law; or
      (2)   Any vehicle in a designated depository maintained in a lawful place and manner by the city.
      (3)   Any vehicle in an enclosed building.
