17.92.030 Board of appeals-Powers and duties.
   A.   The board of appeals is invested with the following jurisdiction and authority:
      1.   To hear and decide appeals from any order, requirement, decision, or determination made by the zoning administrator under this title;
      2.   To hear and recommend to the city council variations from the terms provided in this title in the manner set forth in the applicable statutes of the state and subject to the standards set forth in this title; and
      3.   To hear and recommend to the city council all matters referred to it or upon which it is required to pass under this title.
   B.   Decisions:
      1.   All final decisions arrived at by the board of appeals shall require a majority vote of all its members;
      2.   All recommendations on variations, shall be finally decided by the city council under this title, and shall thereafter be subject to judicial review in accordance with applicable statutes of the state;
      3.   All decisions of the board of appeals on appeals from decisions of the zoning administrator shall, in all instances, be final administrative determinations subject to judicial review in accordance with applicable statutes of the state.
