§ 130.052 PUBLIC CONSUMPTION OF ALCOHOL; DISORDERLY INTOXICATION.
   (A)   Consumption of alcoholic beverages on public sidewalks, highways, and streets.
      (1)   It shall be unlawful for any person within the village to consume any alcoholic beverages on a public sidewalk, highway, or street, or in a vehicle which is moving, standing, or parked on a public street. A public highway or street shall include parking lots or any place open to the public generally, such as, but not limited to, school parking lots.
      (2)   Any person who possesses or has under his or her control an open container which is partially filled with any alcoholic beverage on a public highway or street or in a vehicle which is moving, standing, or parked on a public highway, parking lot, or street shall be presumed to have consumed the beverage in violation of this section.
   (B)   Disorderly intoxication. It shall be unlawful for any person within the village to be intoxicated in a public place and to either endanger directly the safety of another person or of property or act in a manner that causes a public disturbance.
