§ 130.032 LITTERING; COMMERCIAL WASTE.
   (A)   Littering. It shall be unlawful for any person to litter or permit to be littered on any of the streets, alleys, sidewalks, or other public places within the village by throwing, depositing, tracking, dropping, dumping, or spilling any trash, paper, dirt, mud, leaves, grass clippings, garbage, debris, or other materials, or to deposit or cause the same to be deposited upon or permit the same to be accumulated upon any premises other than those designated as official village dumps. Exception to this only by approval of the Village Manager.
   (B)   Commercial waste. It shall be unlawful to discharge any commercial or industrial water or any polluted or contaminated waste upon the sidewalks, streets, alleys, or gutters within the village at any time.
   (C)   Enforcement. All officers of the Police Department, as well as other village employees officially designated as code police, are hereby charged with enforcement of this section and are authorized to issue violation tickets for any violation of this section.
   (D)   Presumptions. In a proceeding for violation of this section involving litter from a motor vehicle, proof that the particular vehicle described in the citation, complaint or warrant was used in the violation, together with proof that the defendant named in the citation, complaint, or warrant was the registered owner of the vehicle at the time of the violation, constitutes in evidence a presumption that the registered owner of the vehicle was the driver of the vehicle at the time of the violation. The driver of a vehicle is presumed to be responsible for litter which is thrown, deposited, dropped, dumped, spilled, placed, or left from the vehicle upon public or private property.
   (E)   Accident cleanup. It shall be unlawful for a person who removes a vehicle wrecked or damaged in an accident on a highway, road, or street to fail to remove all glass and other injurious substances dropped on the highway, road, or street as a result of the accident.
